Lawyers for the NFL, the NFL Players Association and some retired players led by former Viking Carl Eller were in Minneapolis Wednesday before U.S. District Judge Susan Nelson.
At issue is whether the court will order everyone back into mediation before U.S. Magistrate Judge Arthur Boylan, who helped broker the deal between the NFL and the NFLPA.
According to reports, Nelson said the retirees face an uphill battle, but held off on an immediate decision. She told the lawyers to meet with Boylan on Wednesday afternoon to discuss informally whether mediation would be helpful ahead of another hearing scheduled for Sept. 15.
Counsel for the players wrote a letter to Judge Nelson on Monday asking that they not be ordered into mediation stating that the Eller plaintiffs have no claims against the Brady class or any other of the parties named in the action.
Lawyers for the NFL also wrote to Judge Nelson on Monday asking that the case be dismissed.
